Terms of Service

1. Acceptance and provider

These terms govern use of the “Dimensión Fungi” customer mobile app, provided by Dimensión Fungi in Colombia. By checking the box and tapping “Accept and continue,” you confirm that you have read and accepted these terms and the Privacy Policy in the version shown by the app. If you disagree, do not continue and sign out.

2. Age and account

The app is intended exclusively for adults aged 18 or older. You must provide accurate information, keep your password confidential and notify us of unauthorized access. You are responsible for activity under your account unless the law provides otherwise.

3. What the app provides

The app lets you organize routines and habits, schedule local reminders, record intake and wellbeing information, review progress, receive general product-use guidance and export a personal history. Some features require an internet connection and an active account.

Reminders and calculations are organizational aids. Check schedules, quantities and important information before acting.

4. Wellbeing, health and products

The app is a wellbeing self-tracking tool. It does not provide medical services, diagnose, prescribe, treat disease or replace assessment by a healthcare professional. Do not use the app for emergencies. Seek immediate professional care for severe symptoms, adverse reactions or emergencies.

Consult a professional before starting or changing supplements, especially if you are pregnant or breastfeeding, have a medical condition, take medication or may face an interaction risk. Product availability, composition and commercial information may change.

5. Privacy and analytics

Processing of personal data, including sensitive wellbeing data and Microsoft Clarity analytics, is described in the Privacy Policy. Clarity is only activated after acceptance, is not used for advertising and is paused when you sign out.

6. Purchases and external communications

The app may open WhatsApp for information, support or a reorder. Conversations and purchases occur outside the app and may be subject to additional commercial terms disclosed at purchase. Apple and Google are not sellers or responsible for those transactions.

7. Permitted use

You may not use the app unlawfully; attempt to access other accounts or systems; interfere with security; scrape data; copy, decompile or distribute the software except as permitted by law; impersonate others; or introduce malicious code. We may limit or suspend access when reasonably necessary to protect users, data or security, or to comply with law.

8. Information you record

You retain rights in notes and other information you record. You authorize us only to host, process and display it to operate features you request. Do not submit unlawful material or third-party information without authorization. The app currently does not allow public file sharing or public content sharing with other users.

9. Intellectual property

The app, brand, design, text, images, software and other Dimensión Fungi materials are protected by intellectual-property laws. You receive a personal, limited, revocable, non-exclusive and non-transferable license to use the app under these terms.

10. Availability and updates

We may fix, update, replace or discontinue features for technical, security, legal or business reasons. We will seek to communicate material changes. We do not guarantee uninterrupted operation, but will use reasonable care to operate the service and protect information.

11. Liability

To the fullest extent permitted by law, Dimensión Fungi is not liable for medical decisions made without professional advice, use contrary to these terms, loss caused by user-compromised credentials, external-service failures or indirect losses that were not reasonably foreseeable. Nothing in these terms excludes liability or consumer rights that cannot legally be limited.

12. Dispute resolution and arbitration

Before starting proceedings, you and Dimensión Fungi will attempt to resolve the dispute directly for at least 30 calendar days after receipt of a written complaint sent through the contact channel, describing the problem and requested resolution.

If unresolved, any contractual dispute relating to the app that may legally be arbitrated will be resolved individually by a tribunal consisting of one arbitrator deciding in law, administered by the Arbitration and Conciliation Center of the Bogotá Chamber of Commerce under its rules. Proceedings will be in Spanish and may be conducted remotely when permitted. Colombian law applies.

To the extent permitted by law, each party brings claims individually and not as a representative in a class proceeding. You may opt out of this arbitration agreement within 30 days after acceptance by sending your account email and the message “I reject the arbitration agreement” through WhatsApp. Disputes will then be heard by the competent courts.

This section does not limit complaints to Colombia's Superintendence of Industry and Commerce, data-protection authorities or other competent authorities, and does not affect non-waivable consumer rights. Matters that cannot legally be arbitrated will be heard by the competent authority.

13. Termination and deletion

You may stop using the app and delete your account at any time through Profile → Privacy and data → Delete my account. You may also request deletion on the web. Provisions that by their nature should survive—including intellectual property, liability and dispute resolution—will remain in effect.

14. Changes

If we materially change these terms, we will update the effective date and the app will request a new versioned acceptance before allowing access to private features.
